The Florida Clean Air Act (FCAA) was enacted in 1985 by the Florida Legislature. The purpose is to protect people from the health hazards of secondhand tobacco smoke and vapor and to implement the Florida health initiative in s. 20, Art. X of the State Constitution. It is the intent of the Legislature to not inhibit, or otherwise obstruct, medical or scientific research, or smoking or vaping cessation programs approved by the Department of Health. In November 2002, seventy-one percent of Florida's citizens voted for a constitutional amendment to prohibit smoking in all enclosed indoor workplaces.  The smoke free law became effective July 1, 2003. Beginning July 1, 2019 electronic vapor products were included in the FCAA and are prohibited in indoor workplaces.

Enforcement

The Department of Health (DOH) and the Department of Business and Professional Regulation (DBPR) are responsible for enforcement of the FCAA. DBPR shall enforce the FCAA in:

  • Restaurants
  • Bars
  • Billiards
  • Bingo Halls (with food service)
  • Bowling Centers
  • Civic/Faternal Organizations
  • Dog Tracks
  • Horse Tracks

DOH shall enforce the FCAA in all facilities not regulated by DBPR.

The FCAA only regulates tobacco/nitcotine smoke/vapor and does not regulate secondhand smoke/vapor from marijuana. Complaints regarding secondhand exposure to marijuana smoke/vapor should be directed to the Office of Medical Marijuana Use at knowthefactsmmj.com. 

How to Report a Violation of the FCIAA

To register a complaint about a business that may be in violation of the FCAA, contact the following agencies:

To register a complaint, provide the following information:

  • Name of workplace (where violation is occurring).
  • The mailing address, city, county and zip code.
  • Nature of the violation (ex. smoking in an enclosed indoor workplace).
  • If available, provide a telephone number and name of the person in charge of the workplace.
