Statutes

During the 2020 Legislative Session, Section 404.22, Florida Statutes, was amended to provide the following radiation safety practices:

  • Individuals shall only be exposed to the useful beam of a radiation machine when either a licensed practitioner authorizes it in the course of their delivery of health care, or when it has been the determined that the exposure provides a life safety benefit to the individual exposed greater than the potential health risk of the exposure.

  • Radiation machines that are used on humans shall be maintained according to manufacturer's or national consensus standards and must not be modified in a manner that causes them to operate outside the specifications of their original design and as approved by the US Food and Drug Administration.

Regulations

On March 21, 2016 Chapter 64E-5 was changed to provide exemptions for security scanners used in prisons and on inmates.  A list of these changes is included in Information Notice 2017-01 Revision 15 filing instructions.  Changes to Florida Administrative Code (FAC) Chapter 64E-5.  (09-27-2017).

Ionizing Radiation Machines (X-ray)

Annual radiation machine registration invoices are now available at xray.floridahealth.gov. To obtain a copy, you will need your registration number (JR number) & facility zip code.

Radioactive Material 

Additional Protocol (AP) forms for Radioactive Material Licensees to assist in meeting International Atomic Energy Agency (IAEA) treaty obligations (PDF) In accordance with 10 CFR 110.54(a)(1), reports of exports of nuclear facilities, equipment, and certain non-nuclear materials shipped by licensees under general license or specific license during the previous quarter, must be submitted by October 15, 2022, to BIS on DOC/NRC Forms AP-M or AP-13, and associated forms. The reports must contain information on all nuclear facilities, equipment, and nonnuclear materials listed in Annex II of the AP.

Patients recently received Sr-82 and Sr-85 levels well in excess of the breakthrough limits for Sr-82/Rb-82 generators because of elution with Ringer’s lactate solution.

Reminder to Florida licensees that they are required to follow manufacturer instructions, 2019 FDA DARRTS Reference ID # 4425113 or 2019 FDA DARRTS Reference ID # 4425127 and other requirements regarding the use of these generators. Please review your radioactive materials license for details.

Radiologic Technology

A current list of approved radiologic technology educational programs is available.  Select the type of Radiologic Education Program you are interested in (Radiography, Nuclear Medicine or Radiation Therapy), and a list of ARRT accredited programs in that discipline will generate. (09/24/2019).

Laser Radiation

Changes to Chapter 64E-4, Florida Administrative Code were made to reflect newer versions of the ANSI Z136 national standards and 21CFR federal regulations.  Changes were also made to combine the existing laser rule regulation requirements into one rule, 64E-4.001, and one document incorporated by reference, into one PDF, for easier reference.  The document incorporated by reference contains all the other laser radiation requirements formerly found in separate regulations (i.e., 64E-4.002, 64E-4.003, etc.).  No laser requirements were repealed.  (3/28/2017).
