The following rules and information is applicable to radon professionals, facility testing and real estate transactions and for use by closely related activities and industries. 

Florida Radon Laws

Chapter 404.056, Florida Statute authorizes the Radon Program (view the 80 KB PDF version). 

This Statute has six sections describing:

  • Setting public health standards related to radon exposure
  • Certification of businesses and individuals who provide radon services
  • The department's role in educating Floridian's about radon
  • Identification of facilities that must test for radon
  • Radon gas notification in real estate transactions
  • The department's authority to define sections one through five

Realtors: 404.056(5) Florida Statutes

NOTIFICATION ON REAL ESTATE DOCUMENTS.  Notification shall be provided on at least one document, form, or application executed at the time of, or prior to, contract for sale and purchase of any building or execution of a rental agreement for any building. Such notification shall contain the following language:

"RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.
