Receiving health care from unlicensed people is dangerous and could result in injury, disease, or even death.
Medical Quality Assurance Unlicensed Activity Program protects individuals in Florida from potentially serious and dangerous consequences of receiving medical and health care services from an unlicensed individual, according to section 456.065, Florida Statutes.
Investigations are preformed and if Florida laws are not adhered to, referrals are made for prosecution of all unlicensed health care activities.
The program works in conjunction with Florida’s law enforcement agencies and the state attorneyโs offices to prosecute individuals practicing without a license. In many instances, unlicensed activity is a felony level criminal offense.

Complaint Investigations
The Florida Department of Health investigates all unlicensed activity allegations. If the allegation is determined to be legally sufficient, an investigator work to verify the allegations by gathering documents, conducting surveillance, questioning witnesses, etc., to make a determination of unlicensed activity and potentially referral to law enforcement.
- If the complainantโs allegations can be substantiated, the investigation will conclude with the subject(s) will be arrested, subject(s) will be issued a Uniform Unlicensed Activity Citation (Fine), or subject(s) will be issued a cease and desist.
- If the investigation determines that the alleged acts either did not take place or if they did occur but all actions were lawful, the investigation will be closed as unfounded.
- In the event that the allegation(s) cannot be clearly proved or disproved, the matter will be closed as unsubstantiated.
In any case, a detailed investigative report will be prepared by the investigator supporting the conclusions reached by the investigation.
